NZMAA PUBLIC LIABILITY INSURANCE

Introduction - General Outline

The New Zealand Model Aeronautical Association (NZMAA) arranges insurance that provides indemnify for injury or property damage claims caused by an accidental occurrence in connection with the activities of the New Zealand Aeronautical Association. Under the NZMAA’s Constitution, the "Member" is the club through which those covered by the insurance join the Association as "Affiliate Members".

Salient Details of the Cover

It is the responsibility of the "Member Club" to ensure that its members undertake flying activities within the rules and safety requirements of the Association - this is a prerequisite to indemnity being provided by the Policy.

The liability insurance cover provides indemnity for:

a) Personal injury or property damage caused by an occurrence in connection with the business and activities of NZMAA.
b) All classes of model aircraft sanctioned by the NZMAA.
c) Claims arising anywhere in New Zealand and also when an NZ member is participating in an overseas event.
d) Member to member liability in respect of vehicle damage.

The limit of indemnity is $2,000,000 any one occurrence - a sub limit applies in respect of liability under the Forest and Rural Fires Act of $500,000.
Statutory Liability cover is provided under a separate policy for a limit of indemnity of $500,000 any one claim.
An excess of $1,000 applies for each and every claim, of which the member will contribute the first $250.

Special Provisions

A full summary of the insurance is available from the Secretary but:

  1. To claim entitlement for insurance cover, all activities carried out by the Association’s members must be within the bounds of the Aims and Objectives of the Association - as set out in the Rules and By-Laws and as detailed in the General Competition Rules and the Flying Rules.

  2. Damage to model aircraft is not covered.

  3. Personal injury occurring in New Zealand comes within the provision of ACC but legal liability for third party personal injury that may be caused in connection with overseas activities is covered under the Policy.

  4. All members are obliged to keep their clubs informed of the locations where activities are carried out whether for casual flying or for regular club or competition flying. This action forms the "sanctioning" of flying sites.

  5. If any member is operating in areas where model flying is prohibited by central or local government laws (and/or by-laws); or is operating a model which is outside the Association’s rules; or contravenes any Government Department regulations (such as CAA) then the insurance cover is voided in respect of that member in the event of a claim. Operators of all models, and particularly "large" models should study the Civil Aviation Authority Rules 101 governing the operation of model aircraft (included in the NZMAA Member’s Handbook and the Club Manual).

Other Members

In addition to ordinary financial members engaged in flying models, cover extends to include:

a) legal liability of NZMAA caused by bonafide visiting overseas model flyers who are members of an equivalent Association in their home country (if they are not otherwise   covered by their home Association insurance);

b) prospective (new) club members who have yet to pay their club and NZMAA fees. (Note that this cover extends for a maximum of three months from the first date that such a person first operates a model aircraft with the club); and

c) persons who may be assisting at club activities (such as spouses and other appointed volunteers).

Insurance Claim Procedure

If the unthinkable happens and property damage or personal injury is caused to a third party, details of any accidental damage should be notified to the Secretary of the Association - no matter how small or large the claim is likely to be - as promptly as possible. The club when lodging a claim on a member’s behalf, follows the steps below:

  • Records details of the third party’s name, address and also member’s name and address.

  • Location, date, time of occurrence (approx).

  • Description of what happened.

  • If possible, obtain a professional assessment of the value of the injury or damage.

  • Obtain the name of the third party’s insurer (if applicable).

  • Do NOT admit any liability for damage on behalf of the member of the Association - investigation may prove otherwise but you can advise the third party that the circumstance will be notified to the Association’s insurer.

  • If the third party requires repairs or replacement of damaged property to be carried out immediately then such action must only be undertaken by the third party. The subsequent negotiation of costs will be conducted between the Association’s insurer and the third party and/or their insurer.

Write or call the NZMAA Secretary for a claim form to be forwarded to the member - this can also be downloaded from the NZMAA website. The member should complete it with the above details and return it to the NZMAA Secretary. (DO NOT send it direct to the insurer).
